Company Policies

  • Terms and Conditions

    All sales, contracts, agreements and the like between you/vistors/customers and Innovatoys shall be governed by the laws of the State of Washington. The sole venue for any disputes or claims arising in, out of or from this agreement shall be limited to King County, Washington State. For international customers, both parties agree to be specifically excluded from the United Nations Convention on Contracts for the International Sale of Goods and defer solely to the laws of the United States.

    Delvery of goods

    Innovatoys will ship your order to the shipping or ship-to address provided when you placed your order. Innovatoys is not responsible for loss, mis-delivery or return of packages, due to an incomplete or incorrect address provided by you. Innovatoys may re-ship your order at our sole discretion.

    You and Innovatoys agree that delivery of product is considered as accomplished or complete, once USPS. UPS or other applicable shipping service indicates the package as having been delivered. In the event you assert the package as not having been delivered, or delivered damaged, you agree to fully cooperate with any investigation conducted by Innovatoys. This may include, but is not limited to: Providing photographs, written/printed statements from your local post office, and contacting neighbors to inquire about a possible mis-delivery. Should you claim package theft as a reason for non-delivery, you agree to provide by certified mail, a notarized statement claiming theft occurred from you and a valid police report/law enforcement report.

    For International orders, Innovatoys is not responsible for loss, delays, fees, fines, charges, or any other action(s) taken by any Customs Agency or any other governmental or regulatory agency.

    Payment for goods and services rendered:

    Innovatoys.com accepts multiple forms of payment for goods and services rendered. Upon placing an order through or on Innovatoys.com, you agree to pay for such goods and services in full. Innovatoys is not responsible for the levying of any additional fees, charges or taxes upon you by your state or country. Innovatoys is not responsible for any action or inaction taken by your credit/debit card issuer, bank, payments processor or any third-party processor of payments.

    Payment for goods and/or services rendered is payable and due upon placing an order. In the event of any dispute with regard to goods and or services, you agree to notify Innovatoys of such dispute in writing, within 20 days from the date your order was placed on innovatoys.com. You agree that any dispute notification is only considered valid if notarized and sent via certified US Mail within the 20 day window, whether or not email correspondence has been initiated. Should you initiate a chargeback or similar action to withhold payment, prior to our receipt and acknowledgment of your dispute, you agree to pay Innovatoys all reasonable administrative fees related to the handling and processing of said chargeback or similar action to withhold payment.     In the event payment is withheld, such as in the form of a chargeback or other method, Innovatoys reserves the right to collect the balance owed, including any interest and reasonable collection fees, as well as court, legal or other attorney fees. You agree that service of process is complete and valid, once a summons and complaint is sent by email, with a physical copy mailed to the billing address you provided. You agree that in the event of a Court hearing(s) or other such proceedings, your physical presence or appearance by counsel shall be required and may not be waived, except by the agreement of both parties. Washington State law shall govern all transactions between you and Innovatoys. The venue for any and all disputes shall be King County, Washington State. You agree that any information provided by you or otherwise obtained, may be used to collect any debts owed, as well as reported to credit bureaus and other related entities.

    Terms of use revisions and severability

    Innovatoys may revise our Terms and Conditions buy updating them online. You agree that in the event any portion of our terms and conditions is found to be unenforceable, the remainder of the terms and conditions shall remain in full force and effect. By using/visiting this site, you agree to be bound to all terms and conditions, including any and all revisions, whether notified or not. We recommend periodically visiting this page to be informed of any such revisions.

    Force majeure

    Innovatoys and any affiliated companies are not responsible for events beyond our control. This includes, but is not limited to, strike, fire, flood, insurrection or civil disturbance, disruptions due to weather, service delays, acts of God or government, illness, pandemic or availability of goods and services.

  • Return Policy:

    If we ship you the wrong item, or it arrives defective or damaged, we will work with you to quickly exchange the item. Product may be returned for a refund, exchange or store credit within 30 days after your order has been shipped. All returns must be accompanied with a Return Merchandise Authorization number (RMA #). All returned merchandise must be returned in “new” (resalable) condition (judged by us) with all the original packaging, accessories, manuals and other documentation, etc., included where applicable.

    If you change your mind or order the wrong item, we will issue you a refund or store credit for your purchase (minus any shipping and handling fees) within 30 days after your order has been shipped. All returns must be accompanied with a Return Merchandise Authorization number (RMA #). All returned merchandise must be returned in “new” (resalable) condition (judged by us) with all the original packaging, accessories, manuals and other documentation, etc., included where applicable. On select products a 15% restocking fee may also apply. Products marked as “non-returnable”, “clearance” or “close-out” may not be returned.   • Shipping and Handling Charges:

    These charges are based on the total weight of the order as when packed for shipping, including dimensional weight in some cases, and are calculated in US pounds.

    Delayed shipments:
    Please understand that there are many factors which may delay a shipment, such as weather, strikes, or other circumstances which lie beyond our control. Innovatoys cannot be held responsible for such delays.   • Sales Tax:

    Sales tax will be charged for the purchase of non-food items sold to Washington State residents.

  • Foreign Shipping Duty Fees / Taxes:

    Please be advised that your country may impose duty fees, or other taxes based on the product origin and/or value. These fees and taxes are based on your country's import policy, and may be imposed in addition to the purchase price and shipping/handling fees collected by us prior to shipment. All such fees and taxes are the responsibility of the recipient and our company is not responsible for them. We are not be responsible for such fees/taxes on returned items either. If you are concerned about possible additional charges, please contact your local Import/Customs authority for more information.

  • How do I exchange an item?

    Our return center cannot process exchanges. If you have found another item that you would prefer over one you have already received, we ask that you place a separate order for the new item and that you return the unwanted item. Once the returned item has been received at our warehouse, a credit will be issued to your account. Please see instructions above for how to return a package.

  • Damaged Shipments:

    Before accepting a package from FedEx or any other postal service please look over the box. If the outside is damaged in any way, do not open it. FedEx should open the box in front of you and inspect it for damages. If any damages are found FedEx should document them. The package then should be re-taped and sent back to us. Please email our Returns Department and inform us of the situation.

  • Warranties:

    InnovaToys has a 30-day warranty on products that are sold (unless otherwise stated). Claims on products that have manufacturer's warranties should be submitted to and handled by the manufacturer. This includes parts for the equipment, manuals, damages, etc. If the manufacturer is not responsive to your requests, please give us an email and we will try and assist you with the claim.

  • Pricing:

    Product information, photos and prices are subject to change without notice and subject to possible errors. If a change or error affects an unsent order, you will be informed about the changes before your order is processed.

  • Shipping Weight:

    The weight of the product when packaged for shipping.

    Products are either sent from our Washington location, or (when it proves to be more cost-effective) they may be shipped directly from suppliers. Products shipped from suppliers will have the product cost, taxes (if applicable), and shipping added together as one total price.

  • Shipping Info:

    Our order form allows the customer to choose their preference. At the time you finalize your order, our shopping cart connects to the server at FedEx to retrieve the information necessary to calculate shipping and handling for your order. If the FedEx server is busy and cannot supply the necessary information to our shopping cart program, or if the order is to a country outside of the USA and shipping information is not calculated, we will attempt to contact the customer with the correct shipping and handling information before the order is shipped, but if we are not able to contact you we may elect to ship your order without authorization. If you see that the system was not able to calculate your shipping please contact us via email if you do not want your product shipped before we contact you.

    If your order contains items that are shipped by a supplier, they will arrive separately from items we stock at our Washington location, and may arrive via a different shipper.

    In order to use this website, a user may be required to complete a registration form. This information is used to contact the user about the products/services on our site for which they have expressed interest.     We request information from the user on our order form. Here a user must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill customer's orders. If we have trouble processing an order, this contact information is used to get in touch with the user.

    A cookie is a piece of data stored on the user's hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. If a user rejects the cookie, they may still use our site. The only drawback to this is that the user will be limited in some areas of our site.     We use an outside shipping company to ship orders (FedEx, UPS, USPS), and a credit card processing company to bill users for goods and services (PayPal, VeriSign). These companies do not retain, share, store or use personally identifiable information for any secondary purposes.

  • Links:

    This web site contains links to other sites. Please be aware that we Innova Toys & Gifts are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information.   • Newsletter:

    If a user wishes to subscribe to a newsletter offered from our site, we ask for contact information such as name and email address.

  • Correction/Updating Personal Information:

    If a user's personally identifiable information changes (such as their zip code), or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user's personal data provided to us. This can currently be done by emailing [email protected].

  • Tell-A-Friend:

    If a user elects to use our referral service for informing a friend about our site, we ask them for the friend's name and email address. InnovaToys will automatically send the friend a one-time email inviting them to visit the site. InnovaToys stores this information for the sole purpose of sending this one-time email.   • Security:

    This website takes every precaution to protect our users' information. When users submit sensitive information via the website, their information is protected both online and off-line.

    When our registration/order form asks users to enter sensitive information (such as credit card number and/or a password), that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers such as Firefox and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when you are just 'surfing'.

    While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect user-information off-line. All of our users' information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information.
